The defendant, John B. Chavez, was charged by information with attempted second degree burglary*fn1 and with being a habitual criminal.*fn2 After a trial at which he did not testify, the jury convicted Chavez of both charges. Chavez appealed the convictions, and the court of appeals reversed, holding that the trial court's advisement regarding the defendant's right to testify was insufficient to support an inference that the defendant's relinquishment of his right to testify was a valid waiver of that right. People v. Chavez, 832 P.2d 1026 (Colo. App. 1992). We granted certiorari and now affirm the judgment of the court of appeals.
